Welcome to PartyRentalsHub.com (“PartyRentalsHub,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, marketplace, and related services (“Platform”). By accessing or using PartyRentalsHub.com, you agree to these Terms. If you do not agree, please do not use the Platform.

  1. Role of PartyRentalsHub

PartyRentalsHub is a marketplace connecting vendors (who list party rental items) with customers (who book those items).

We do not own, operate, or control the rental items listed. Vendors are independent businesses, solely responsible for their listings, deliveries, safety, and compliance with laws.

PartyRentalsHub facilitates listings, bookings, and payments but is not a party to rental contracts between vendors and customers.

  1. Eligibility

You must:

Be at least 18 years old.

Have the authority to enter into a binding contract.

Provide accurate, current, and complete information during sign-up.

  1. Vendor Obligations

Vendors agree to:

Provide accurate descriptions, photos, and pricing for all listings.

Maintain proper licenses, permits, and liability insurance (where applicable).

Ensure rental items are safe, clean, and in good working order.

Handle delivery, setup, and pickup as described in their listing.

Comply with all local laws and regulations.

Honor bookings made through the Platform.

Accept PartyRentalsHub’s service fee and commission structure.

  1. Customer Obligations

Customers agree to:

Provide accurate event details (location, time, contact information).

Ensure safe access for delivery, setup, and pickup.

Follow all vendor instructions and safety rules (e.g., bounce house supervision, weight limits).

Return items in the same condition received, subject to normal wear and tear.

Be responsible for any damage, loss, or theft during their rental period.

  1. Bookings & Payments

Bookings are confirmed once payment is processed through our secure payment system.

PartyRentalsHub holds payments and releases payouts to vendors after the event, subject to service fees.

Vendors set their own pricing and policies, but all transactions must go through the Platform.

Customers authorize PartyRentalsHub to charge their chosen payment method for rental fees, service fees, deposits, and applicable taxes.

  1. Cancellations & Refunds

Each vendor sets their own cancellation and refund policy (flexible, moderate, strict, or custom).

Customers must review vendor policies before booking.

PartyRentalsHub may mediate disputes but is not obligated to provide refunds beyond what the vendor policy states.

  1. Service Fees

PartyRentalsHub charges vendors a commission/service fee on each booking.

Fees are disclosed before listing activation and may be updated with notice.

  1. Taxes

Vendors are responsible for reporting and remitting any sales tax, income tax, or other taxes arising from their rentals.

PartyRentalsHub may collect and remit taxes where required by law.

  1. Liability & Insurance

Vendors must maintain general liability insurance, especially if renting inflatables, tents, or equipment with safety risks.

Customers assume risk of injury or damage when using rental items.

PartyRentalsHub is not liable for accidents, injuries, damages, cancellations, or disputes between vendors and customers.

  1. Prohibited Conduct

You may not:

Misrepresent your identity, listings, or bookings.

Circumvent the Platform to avoid paying fees.

Post fraudulent, harmful, or illegal content.

Damage or interfere with the Platform’s functionality.

  1. Dispute Resolution

PartyRentalsHub encourages vendors and customers to resolve disputes directly.

If unresolved, PartyRentalsHub may (at its discretion) step in to mediate.

Any legal disputes must be resolved through binding arbitration under the laws of California, USA, and not in court.

  1. Limitation of Liability

To the maximum extent permitted by law:

PartyRentalsHub is not liable for indirect, incidental, special, or consequential damages.

PartyRentalsHub’s total liability for any claim will not exceed the total service fees you paid us in the 12 months preceding the incident.

  1. Account Suspension & Termination

We may suspend or terminate accounts if:

Vendors or customers violate these Terms.

Fraudulent, unsafe, or illegal activity is detected.

Required documents (e.g., insurance, W-9) are not provided.

  1. Privacy

  1. Updates to Terms

We may update these Terms at any time. Updates will be posted with a revised Effective Date. Continued use of the Platform constitutes acceptance of updated Terms.
